Terms and Conditions

§1 Scope of Application

The following Terms and Conditions (hereinafter “T&C”) apply to all services offered by building trust Hundetraining.
Use of the offered services without prior acceptance of these T&C is not possible.
The version valid at the time of booking shall apply in each case.
building trust Hundetraining reserves the right to amend or supplement these T&C.
The amended version shall only apply to new bookings, unless the participant has expressly accepted the new version for ongoing training services.
Deviating terms and conditions of the participant shall not be recognized. This also applies if building trust Hundetraining does not expressly object to their inclusion.

§2 Contracting Parties and Conclusion of Contract

The contract is concluded between

and a consumer or entrepreneur.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed in nature (§ 13 German Civil Code – BGB).
An entrepreneur is a natural or legal person or a partnership with legal capacity who acts in the exercise of their commercial or self-employed professional activity (§ 14 BGB).

§3 Subject Matter of the Contract

The contract is concluded upon booking confirmation or invoicing by building trust Hundetraining.
The content of the contract is determined by the service description at the time of contract conclusion.

§4 Obligations of the Participant

By concluding the contract, the participant agrees to the following provisions:

1. Participation takes place at the participant’s own responsibility and risk.
building trust Hundetraining, as the organizer, is not liable for damage to persons or animals.
The participant is liable for all damage caused by themselves and/or their dog, including damage to third parties.
Liability is excluded for damage caused by third parties and/or their dogs.

 

2. During the service, the participant must follow the trainer’s instructions.
The participant alone is liable for damage caused by non-compliance with these T&C, the rules of conduct, or the trainer’s instructions.
The participant is also liable for all personal injury, property damage, and financial loss caused by themselves or their dog during the event, including damage caused by negligence.

 

3. building trust Hundetraining assumes no liability for personal injury, property damage, or financial loss resulting from exercises demonstrated or explained, including damage caused by other participating dogs.
The participant must inform any accompanying persons of these T&C and the rules of conduct.

 

4. The participant agrees to comply with the rules of conduct provided by building trust Hundetraining.

 

5. Upon conclusion of the contract, the participant confirms that the participating dog has valid liability insurance and is properly registered for tax purposes.
Proof must be presented upon request.

 

6. Upon conclusion of the contract, the participant confirms that the dog is free from parasites and contagious diseases and has age-appropriate, up-to-date vaccinations.
If parasites or contagious diseases are detected, the dog owner shall bear any resulting costs for treatment of other animals or compensation for damage caused by infection of other participants or dogs.
The participant must immediately inform building trust Hundetraining of any contagious disease, parasite infestation, or suspicion thereof during the training period.

 

7. Upon registration, the participant must inform building trust Hundetraining of all safety-relevant incidents and risks that have occurred in the dog’s life.
Behavioral issues, excessive aggression, or fearfulness must be disclosed prior to the first training session.

 

8. The participant confirms that their dog is kept and handled in accordance with animal welfare laws and agrees to refrain from using pain- or fear-inducing methods or tools.

 

9. Participation with a sick dog is only permitted if the dog is capable of taking part without pain, suffering, or worsening of its condition, and if no risk to other animals exists.
The trainer must agree to the participation.
A veterinary certificate may be required.

 

10. Participation with a dog in heat is only permitted with prior agreement from the dog school.

 

11. The participant is obliged to cooperate within the contractual relationship and shall provide required cooperation without delay upon request.

§5 Payment Terms and Default

1. Current prices are listed in the price list provided by building trust Hundetraining. Price adjustments are reserved.

 

2. Payment is due in full immediately upon receipt of booking confirmation or invoice.

 

3. Payment may be made in cash or by bank transfer to the account stated on the invoice.
Cash payments must be made no later than the start of the booked service.

 

4. For individual training sessions, dog care services, and depending on agreement, travel costs are charged for trainer travel beyond 10 km at €0.50 per km.
These costs are due with invoicing or must be paid in cash before the service begins.

 

5. Discounts and vouchers are valid only for the specified promotional period.
Cash payment of vouchers or discounts is excluded.

 

6. In the event of late payment, statutory regulations on default shall apply.

§6 Withdrawal by Participants

1. Registration for a service is binding. Fees already paid will not be refunded.

 

2. The participant may withdraw prior to the start of the service in writing or text form.
The date of receipt by building trust Hundetraining is decisive.
In case of withdrawal, compensation for expenses may be claimed.
Cancellations less than 24 hours before the appointment will be charged at 100%.

 

3. Separate cancellation conditions may apply for events and will be communicated upon registration.

 

4. Unused services will not be refunded.

§7 Withdrawal by building trust Hundetraining

1. building trust Hundetraining reserves the right to withdraw from the contract in whole or in part for valid reasons, including:

In such cases, participants are entitled to a replacement date.

  • Failure to reach the minimum number of participants

  • Acute illness of the trainer

  • Force majeure (e.g. severe weather, official orders, pandemics, natural disasters)

2. building trust Hundetraining may exclude participants or terminate training sessions if:

In these cases, no refund or replacement date will be granted.

  • the dog’s health prevents lawful training,

  • the participant uses excessive force,

  • instructions are repeatedly ignored,

  • required documents are not provided.

building trust Hundetraining also reserves the right to refuse bookings without stating reasons. Any payments made will be refunded in full.

§8 Insurance Coverage

The participant is responsible for ensuring adequate insurance coverage for themselves and their dog.

§9 Liability

1. building trust Hundetraining is liable only in cases of intent or gross negligence.

 

2. No liability exists for damage resulting from exercises performed by participants or caused by participating or accompanying animals.

 

3. The participant is liable for all damage caused by themselves or their dog.

 

4. Failure to follow instructions results in exclusive liability of the participant.

§10 Exclusion of Guarantee of Success

1. No guarantee of training success can be given, as success depends on participant cooperation and implementation.

§11 Copyright

1. All images, videos, texts, and materials provided are protected by copyright.
Use without written consent is prohibited.

 

2. Training materials may not be reproduced, processed, or distributed without written permission.

 

 

§12 Image, Video, and Audio Material

1. Participants may not publish recordings without written consent.

 

2. building trust Hundetraining may create and use recordings unless participants object before the event begins.

 

 

§13 Final Provisions

1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

 

2. The place of jurisdiction is the provider’s registered office where legally permissible.

 

3. Should any provision be invalid, the remaining provisions shall remain unaffected.
